Tom Simon, City Prosecutor
Margaret Draper, Assistant City Prosecutor
110 West 44th St.
Ashtabula, Ohio 44004RE: The Tuesday, June 29, 2004 prosecution of Mr. Barry A. Shelott and Ms. Cassie R. Warsing of Ashtabula, Ohio.
Dear Mr. Simon and Ms. Draper,
We are writing this letter to draw your attention to the animal cruelty that occurred at the hands of Mr. Barry A. Shelott and Ms. Cassie R. Warsing on May 12, 2004 in Ashtabula, Ohio. This extreme incident of cruelty occurred near 627 Bunker Hill Road in Ashtabula, Ohio.
The event began after 9:30 p.m. on Wednesday, May 12, 2004 when Mr. Mark Roloson took his dog Tigger, a 12-pound, 11-month-old Pomeranian, outside. Soon after, Mr. Roloson returned to retrieve Tigger, but saw the little dog walking on the road toward the yard, dragging his back paw. Then, Mr. Roloson, accompanied by his neighbor, Mr. Kelly McConnell, watched in horror as Mr. Barry A. Shelott and Ms. Cassie R. Warsing used a vehicle in their possession to drive over Tigger, hitting him with both a front and a back tire. The driver swerved to hit Tigger directly. Suddenly, Mr. Roloson saw Tigger lift his head. Before Mr. Roloson could get to him, Mr. Shelott and Ms. Warsing steered their vehicle to hit Tigger again. Mr. Roloson immediately called 911 and filed a report with the Ashtabula Police. The Roloson family buried Tigger the next day.
Although Mr. Barry A. Shelott and Ms. Cassie R. Warsing have pleaded “Not guilty,” eye witness accounts of the incident depict a horrific and cruel scene of torment and torture inflicted upon Tigger. Ashtabula Police believe that Mr. Shelott and Ms. Warsing switched seats and repeatedly drove over Tigger while he laid bleeding and dying in the street. Mr. Shelott and Ms. Warsing are no strangers to the Ashtabula courts. Each has faced court appearances within the last year. This was a deliberate and premeditated attack on a very small, defenseless dog. The incident is a clear indicator that Mr. Barry A. Shelott and Ms. Cassie R. Warsing are dangerous to society, and we are gravely concerned that lack of fervent reaction from the Ashtabula County Court will contribute to public ignorance regarding responsible pet ownership
Animal lovers throughout the U.S. are outraged at Mr. Shelott’s and Ms. Warsing’s behavior. As animal advocates, we are highly sensitive to the issues surrounding Ohio state ordinances regarding animal abuse. We are also well aware of the Ashtabula County Humane Society’s obligation to educate the public on the compassionate manner in which animals must be treated.
As you have the power to compassionately address this matter, we urge you to make note of the way in which Tigger’s life was taken. No living being should be treated with such disregard and inhumanity. We are extremely saddened by the unimaginable anguish and despair Tigger experienced. Please assist in sending a strong message that violence against any creature – human or not – is unacceptable. Please do not contribute to the pattern of societal neglect that chooses to overlook animal welfare issues. You can help the Ashtabula community in their effort to prevent this cruelty from occurring at the hands of these people again.
Therefore, the reasons we seek your help are twofold. One, we wish to prevent Mr. Shelott and Ms. Warsing from inflicting such misery onto other animals. Second, we hope to educate the citizens of Ashtabula, Ohio on the consequences of abusing animals. Specifically, if an individual is found to have mistreated an animal in any way, they will be severely penalized. The only way to assist in curtailing and/or preventing Mr. Shelott’s and Ms. Warsing’s violent behavior is to confiscate any animals currently under their care and to impose on each a maximum sentence of 3 months in jail, psychological counseling, and a hefty fine. This is a much more merciful sentence than Tigger received. Please use your authority and human kindness to prosecute Mr. Barry A. Shelott and Ms. Cassie R. Warsing accordingly.
We sincerely thank you for pursuing charges against Mr. Barry A. Shelott and Ms. Cassie R. Warsing. Now, we implore you to pursue the maximum possible sentence of three months in jail, the largest fine the law will allow, psychological testing, and confiscation of animals in their possession. We also ask that you assist the Ashtabula community in establishing stiffer penalties for those convicted of animal cruelty.
Thank you for your swift attention to this matter.
Sincerely,
Animal Welfare Advocates

June 11, 2004 at 2:48 am #1032604And the punishment handed down to those two should be to give them the same treatment they gave that poor dog.
How can people do things like this? Some people have no conscience.. I would have called them animals, however, that would be an insult to animals.

I have watched a good bit of the Animal Police on the Animal Planet channel and get sick to my stomach.
All I can say is if I saw that happening I would be in jail myself for what I had done to those creatures that did it. I do believe that I could plead temporary insanity though. Horrible, just horrible.

ASHTABULA —It has been a called bizarre, unbelievable and disgusting story.
At about 10:05 p.m. Wednesday, Mark Roloson was tucking his 6-year-old daughter, Tessa, into bed. But she noticed a strange noise.
She heard a whimpering dog outside the family’s home at 627 Bunker Hill Road and told her dad.
Roloson walked downstairs and opened the front door to see the family’s 11-month-old Pomeranian, Tigger, walking on the road toward the yard and dragging his back paw. He had been run over by a car.
Roloson shut the front door and told his daughter he had to check on Tigger.
As soon as he opened the door again, he saw a white car run over Tigger again, this time with a front and a back tire. Tigger was within a foot of the curve and the car had to swerve to hit him, Roloson said.
Roloson took a step back, told Tessa he thought Tigger was dead and then heard someone coming up on the porch. He was his neighbor, Kelly McConnell, who had witnessed the whole incident from his front porch.
McConnell lives right next door at 623 Bunker Hill Road. His daughter had heard the same whimpering from her upstairs window, which was open.
He had seen the same early model white Mercury Marquee or Grand Marquee drive by slowly and then turn around in his yard, before aiming and hitting Tigger the second time.
After being hit a second time, Tigger wasn’t moving. McConnell offered to get a wheelbarrow to move Tigger out of the road while Roloson sat inside and comforted Tessa, who was crying hysterically.
Roloson called 911 and then looked out the door at Tigger. Suddenly, Roloson saw Tigger lift his head up. He told Tessa and McConnell.
“I no more got that out of my mouth, and there was that white car again. Thump, thump,” Roloson said.
That’s right. The same car hit Tigger a third time. The driver had to steer right to hit Tigger the second and third times, both Roloson and McConnell said.
“I thought, I just can’t believe I witnessed that,” McConnell said. “It’s unbelievable. I would have gotten the license plate if I’d of know that’s what he was going to do, but I thought he was stopping to help.”
The first time, the car was eastbound but was westbound the second and third times. Roloson figured the driver must have gone around the block.
Roloson said Ashtabula Police Patrolman John Koski arrived to handle the call. Roloson said Ashtabula police pulled over a car matching the description and cited the driver with driving under suspension. Roloson said animal cruelty charges were pending.
Ashtabula Police Capt. Phil Varckette said the report was incomplete but he wasn’t aware that anyone had been arrested in connection with the incident.
Roloson let Tigger out into the backyard at about 9:30 p.m. Wednesday and Tigger was in a harness. But he somehow got loose from the harness, crawled under a gate and made his way to the road.
Tigger was a little dog and weighed only 12 pounds. He had just gotten a lion hair cut. He had a big mane, close shave on his body and a lot of hair at the end of his tail. He was lovely, energetic and playful, said Josh Roloson, Tessa’s 23-year-old brother.
“He was always happy to see you,” Josh Roloson said.
Tessa said she often called Tigger “Doof,” short for Doofus, because he got himself wrapped into things.
“He was a little dog who thought he was a giant,” said Mark Roloson.
Roloson purchased Tigger from a local breeder for $350 and invested another $250 on his veterinarian care. Roloson buried Tigger Thursday.

DEFENDANT BARRY Shelott (right) looks over paperwork with his attorney, Robert Naylor, Monday during Shelott’s arraignment in Ashtabula Municipal Court.——————————————————————————–

ASHTABULA — Demonstrators stood outside Ashtabula Municipal Court Monday as two people were arraigned for allegedly running over a Bunker Hill resident’s Pomeranian three times.
Barry Shelott, 42, of 917 Bunker Hill Road, Ashtabula, and Cassie Warsing, 24, of 81 Van Epps Ave., Geneva, both were arraigned at about 9:45 a.m. Monday.
They were charged with driving under suspension and injuring animals, a second-degree misdemeanor. If convicted of injuring animals, they each could receive a maximum sentence of 90 days in jail and $750 in fines, said Kym Harley, the chief criminal clerk at Ashtabula Municipal Court.
Conneaut attorney Robert Naylor represented Shelott and Warsing.
Both pleaded not guilty to both charges. Judge Albert Camplese set bond at $2,000 personal recognizance on each charge for both defendants.
Mark Roloson owned the dog that was killed. The not-guilty pleas disgusted him.
“Being that they already admitted what they did, it’s a ploy by their attorney to come back at the pretrial and try to cut a deal for lesser fines and probation instead of jail time,” Roloson said.
Shelott and Warsing both had suspended licenses when the incident occurred, according to court records. Warsing was convicted of driving under suspension in Western County Court.
Shelott has been convicted three times of driving under the influence during the past 11 years: twice in Ashtabula Municipal Court and once in Western County Court, according to City Solicitor Tom Simon. The convictions were in 1993, 1999 and 2003.
Shelott works at Molded Fiber Glass.
Warsing wore an olive green suit and Shelott wore a gray suit during their arraignments. Both declined comment before or after they appeared in court.
Outside of the justice center, protesters held red signs with black print.
Ellen Kolman organized the protest of animal advocates. She held posters that read, “Justice for the puppy,” and “A puppy today … a child tomorrow ”
Gloria Laveck held a sign that read, “Stop animal cruelty in Ashtabula!” while Traci Vallone-Siers held a sign that read, “Make an example of the puppy murderers!”
Kolman said she was sickened to hear about someone killing a defenseless dog for fun.
“Someone has to stand up and say, ‘We’re not tolerating this,’ ” Kolman said. She believes Shelott and Warsing should be given the maximum fines and sentences.
The dog was hit on Bunker Hill Road Wednesday night.

ASHTABULA — After his 11-month-old Pomeranian was run over Wednesday, Mark Roloson never expected so many people to offer to give him a dog.
In all, 23 people contacted Roloson with offers of a new puppy. Pomeranian breeders even offered puppies to replace Tigger, the Pomeranian who was killed.
When Roloson’s 6-year-old daughter, Tessa, met Jasmine, a 4-month-old German shepherd and Australian dingo mix, she immediately decided she wanted to keep the puppy.
“I thought she was a good dog,” Tessa said. “She likes to play with me.”
Tessa said Jasmine, with a caramel and brown-colored coat, is cute and well behaved.
Roloson was happy about the family’s new dog.
“I think she’s a good dog,” he said. “She listens, and she seems to have taken right to us.”
Jasmine was donated by an Ashtabula woman named Robin. Robin moved into an apartment and didn’t realize she wasn’t permitted to have a dog. So she decided to donate her puppy to the Rolosons.
Roloson said six people have stopped by his house to express sympathy about Tigger and he has received 15 calls from friends and family, who said they were shocked and sorry.
The incident began around 10 p.m. Wednesday, when Tessa heard a whimpering dog outside the family’s home at 627 Bunker Hill Road.
Roloson opened the front door to see Tigger walking on the road toward the yard, dragging his back paw. He had been run over by a car.
Then he saw a white car run over Tigger again, this time with a front and a back tire. Tigger was within a foot of the curb, Roloson said.
Tigger wasn’t moving. Roloson called 911 and then looked out the front door at Tigger. Suddenly, Roloson saw Tigger lift his head up. Then, the same white car aimed and hit Tigger a third time, Roloson said.
Authorities said they believe a man and woman took turns driving over the dog.
Roloson said a police officer told him the man and woman who were charged with injuring animals in connection with the incident said they were merely trying to put Tigger out of his misery.
“It wasn’t up to them to decide to do that,” Roloson said. “If they were so concerned, why didn’t they stop and start knocking on doors ”
He also said Tigger wasn’t in critical condition after being hit the first time and would have lived.
