Copyright free photos?

I have been asked to do a feature for a magazine which will include a demo of my work. I really want to include a painting that I have done from a photo here at Wetcanvas in the reference library.

My question is ... can I submit the actual photo to be published along side my work or does the actual photo itself contain copyright??? I have sent an email to the person who took the photo and have had no reply. Do I go ahead and submit my feature with credit to the photographer as their user name only as I don't know their real name, or should I to be on the safe side, start all over again with one of my own photos???

Holley,
It is my understanding that the photographers who post their photos in the RIL have given permission to Wet Canvas members to use the photos as references. However, they still retain the copyright for the photos themselves.

Since this is going to be published in a magazine feature, I would err on the side of caution and wait until I received permission from the photographer before reproducing it in the magazine. This is just my personal opinion though, so it might be good to hear what others think as well.

BTW, CONGRATULATIONS on being asked to do the feature showing a demo of your work. That's really good news!

Yes you have permission, but it's courteous to ask permission and acknowledge the source in the article.

That's probably the best thing to do, for your own peace of mind about the painting. That way there will be NO doubt about the copyright.

As I said before you may use any of the RIL photos as a reference and may sell the paintings. It is nice to acknowledge the photographer. Check out the conditions HERE.

If entering competitions you may be restricted to using your own photographs however.
