While you may not have to get a release or permission of a famous person to use their likeness (especially if they are in the area of public domain), you will have to get the permission of the publisher, artist, and/or photographer...they, technically own that image.

I believe that public figures' likeness can be painted based on a "fair use" policy, but a private individual has privacy rights that you would be violating if you were to publish or make use of his likeness without express permission. I always have clients sign a release permitting me to make copies of their portrait or to use it in promotional materials, while clarifying that even though they have physical possession of the work, all copyrights belong to me and they can't copy, photograph, or alter the work.
