Is it legal to refuse sale to a particular collector?

Repetitive pattern over the course of a decade — Collector, a medical practitioner of some large-City-notoriety and no doubt ample finances, contacts artist wanting inventory lists of available originals. Artist furnished collector with requested inventory. Collector wants prices on x number of particular pieces. Artist furnishes collector with price list. Collector wants artist to run down for him what inspired each of the pieces in question. Artist furnished collector with accounts of what was the inspiration behind said pieces. Collector makes vague statement to artist which could be construed as a put down of the work’s given inspirations and is not heard from again for another year-and-a-half or two years at which time he repeats the same, identical stunt.

Is it legal (USA) for the artist to tell this collector not to darken the doors of artist’s physical or cyber space anymore, that the artist will not be selling to said collector under any circumstance, and for the artist to suggest to this collector that, if he wants to purchase artwork produced by the artist, to go hunt some up that another collector owns and try to talk him/her out of it?

Yes it is legal to refuse service to anyone as long as it has nothing to do with race, skin color, national origin, gender, disability, religion, or age. Being a pain in the butt and stupidity are not on the list.

If you don't want to sell to him don't replay to him or mark up everything by 300% for having to play his games.

Mark his emails as junk/spam as that is what is seems to be..
Ignore that person..if they really are serious they will come to you to buy, with money in hand..

Hi RCharleston,

The things that the collector is requesting is the same as most collectors want to know. What's available? How much is it? Tell me the inspiration.

Why not put availability, prices and inspiration blurb on your website? It will save you time in the long run and enhance the website visitor's experience.

Rather than making an enemy of the person by telling them you won't sell them anything, I would just ignore their requests. If they started calling me on the phone I would block their number.
