I question the use of Dale Chihuly's glass sculpture under the intelectual property laws. I presume permission has been obtained from the artist as this reproduced work does not fall under public domain.

Here's where copyright does not apply. If you take a photograph in a public place and you are the photographer ( as she was.) Otherwise, you could not photograph ANYTHING made by man. She also photographed a tea set. That set also has a patent but the photograph of the set is hers. It's a little sticky as copyright laws are confusing enough.
