Okies, so I originally posted this in the illustration forum, but it was suggested by many that I should bring it over here to have you all give me your advice.

A guy wants me to do an picture for him, so he can buy it. Also, he wants to buy the rights so he will be able to make postcards and stuff with the image for his organization.

I'm wondering what I should charge him for. I figure I will charge him for the final image as he wants to purchase it. But, the part where it gets into rights for reproductions - that's where I am not as sure. Should I ask for some percentage of the prophit off his postcards and stuff (something like %15?) Or should I ask for a straight-up fee and he can do whatever he wants with it.

What advice could you perhaps give me on this situation?

hi axl!

If its a logo that will represent the company then by all means sell him the rights, but have him pay handsomely for it, after all, he will be using it extensively.

On the other hand, if its a piece of artwork, and you want to retain your identity within the work, you could give him specific limited use as set forth by a lawyer in a contract (i.e. the right to a certain number of reproductions within a certain time frame, for either a percentage royalty or a flat fee).

What is his financial situation? Maybe he can pay you in stock if he's just starting out.

Remember too that you can sell him certain rights to reproduction (which should be limited and stated in the contract) and still keep your own rights to use the image for different purposes in future. (for your promotional materials and catalogues, particularly)
